From what I can see, all of these links are from over a year ago. I've read through them and it seems like they started trying to enforce it around the middle or end of last year with an update to the EULA in May of 2016. However, HavocMC was never placed as a blacklisted server so I don't see any source for concern as of the moment. Even servers that were blacklisted at that point in time (currently referencing DesiredCraft as a specific) are still up and running on current versions of Minecraft while still being considered "pay to win" to one extent or another. In my opinion, I don't think anyone on the server has anything to worry about as far as the EULA goes. As of current, there's been no announcement of an impending removal of ranks (nor do I think this will become a problem) and the server is currently listed as supporting versions 1.8-1.11.

I'm just throwing out my opinion on the matter based on the links you provided. I don't own Mojang or the server or anything to that extent. Could things change in the future regarding this? Of course. But so far it's not appearing as though this is going to be a big deal seeing how old of an ordeal it is. That and if they were really going to buckle down on that section of the EULA, they'd be shutting down the vast majority of servers. I've never personally come across a server that doesn't offer a shop for something.

This information is old as hell over a year ago, mojang doesn't care to blacklist servers. Nobody should worry about this.

This is really old but besides from that what is the point? TMD is perfect at it's stage right now and will only change when it get's reported to EULA which the next wave is end of this year. HavocMC won't get shut down by EULA in other words.
